Sunshine Law Records Request
The Board of Trustees of the Jackson County Community Mental Health Fund (CMHF) is a public governmental body under Missouri law. In accordance with RSMo 610.028.2, this policy document governs the release of information on any meeting, record or vote of CMHF.
Public Records
Except to the extent closed by CMHF in accordance with RSMo 610.021, all CMHF public records will be open to the public for inspection and copying. “Public records” has the meaning given in RSMo 610.010(6).

Response Timeframes
Each request for access to a public record of CMHF will be acted upon as soon as possible, but in no event later than the end of the third business day following the date the request is received, unless there is reasonable cause to exceed three business days.
If access to the public record is not granted immediately, the custodian will give a detailed explanation of the cause of the delay and the place and earliest time and date that the record will be available for inspection.
If a request for access is denied, the custodian will provide, upon request, a written statement of the grounds for such denial. Such statement will cite the specific provision of law under which access is denied and will be furnished to the requester no later than the end of the third business day following the date that the request for the statement is received.
Format of Records
If records are requested in a certain format, CMHF will provide the records in the requested format, if such format is available.
If a public record contains material which is not exempt from disclosure as well as material which is exempt from disclosure, CMHF will separate the exempt and nonexempt material and provide access to the nonexempt material.
No person may remove original public records from the CMHF offices without written permission of the custodian.
Fees
The fees that may be charged for access to and, upon request, receiving copies of public records are set forth below:
- A fee of (i) up to 10 cents per page may be charged for paper copies not larger than 9” by 14” and (ii) a fee up to the actual cost for larger paper copies larger. For such larger paper copies, an hourly fee may also be charged for CMHF staff time, which will not exceed the average hourly rate of pay for the staff required for making the copies.
- An hourly fee may be charged for (i) duplicating time, not to exceed the average hourly rate of pay for CMHF clerical staff, and (ii) research time required for fulfilling records requests, at the actual cost of research time. Based on the scope of the request, CMHF will produce the copies using CMHF staff that results in the lowest amount of charges for search, research and duplication time.
- An hourly fee may be charged for providing access to public records maintained on computer facilities, recording tapes or disks, videotapes or films, pictures, maps, slides, graphics, illustrations or similar audio or visual items or devices, which will not exceed the average hourly rate of pay for CMHF staff required for making the copies and programming, if necessary, and the cost of the disk, tape, or other medium used for the duplication. For duplications of certain types of records requiring special expertise, the hourly fee may include the actual rate of compensation for the trained staff member. In addition, if programming is required beyond the customary and usual level to comply with a request for records or information, the fees for compliance may include the actual costs of such programming.
Payment of copying fees may be requested by CMHF prior to the making of copies and prior to CMHF producing copies of the requested records, the person requesting the records may request an estimate of the cost to the requester.
